ShiftFinder Inc. (“ShiftFinder,” “we,” “us,” or “our”) is committed to protecting the privacy of individuals who use our platform, mobile applications, and related services (collectively, the “Platform”). This Privacy Policy explains how we collect, use, disclose, and protect personal information in compliance with the Personal Information Protection and Electronic Documents Act (PIPEDA), Ontario’s Personal Health Information Protection Act (PHIPA) where applicable, and other Canadian privacy legislation.
1. Scope and Consent
By registering for or using the Platform, you consent to the collection, use, and disclosure of your personal information as described in this Privacy Policy. If you do not agree, you should not use the Platform. Where consent is required beyond what is reasonably expected in context, we will seek express consent.
2. Information We Collect
We may collect personal information directly from you, automatically through your use of the Platform, and from third parties such as licensing bodies, background check providers, or references.
Information may include:
– Contact and account information, such as your name, email, phone number, address, username, and password.
– Professional information, including licensing details, certifications, professional history, training, insurance details, credentials, and skills you provide in your profile.
– Client information, including facility name, contact details, job title, location, and details of posted shifts.
– Shift data, including applications, time logs, attendance, confirmations, ratings, and communications between Clients and Contractors.
– Payment information, such as billing addresses, payment method details, and transaction history. ShiftFinder uses third-party payment processors (currently Stripe) and does not store full credit card numbers.
– Automatically collected data, such as IP addresses, device identifiers, browser information, app usage logs, and location data to verify attendance or suggest nearby shifts.
– Communications and feedback, including inquiries, support messages, ratings, and reviews submitted through the Platform.
Where Contractors provide services in healthcare environments, incidental personal health information may be processed. Such information is handled in accordance with PHIPA and only to the extent necessary for the performance of shifts.
3. Use of Information
We use personal information to:
– Operate and provide the Platform, including user registration, profile creation, and authentication.
– Facilitate the posting, matching, confirmation, and fulfillment of shifts.
– Process payments to Contractors and collect service fees from Clients.
– Verify professional qualifications, licenses, and compliance with applicable laws.
– Communicate with you about shifts, payments, Platform updates, and support inquiries.
– Enhance and improve the Platform through research, analytics, and quality control.
– Monitor compliance with our Terms of Service, enforce our rights, and prevent fraud or misuse.
– Meet legal and regulatory requirements, including responding to lawful requests and maintaining appropriate records.
We may also use aggregated or de-identified information for research, reporting, and business purposes, which cannot reasonably identify you.
4. Sharing of Information
We may disclose personal information in the following circumstances:
– Between Users: Contractors and Clients receive necessary details about each other to arrange and complete shifts.
– Service providers: We share information with third-party providers such as payment processors, hosting providers, communication tools, and background check services, strictly as needed to provide services on our behalf.
– Regulators or licensing bodies: To verify credentials or respond to professional conduct matters.
– Business transactions: In the event of a merger, acquisition, reorganization, or sale of assets, personal information may be transferred as part of the business assets.
– Legal obligations: Where required to comply with applicable laws, court orders, or to protect the safety, rights, or property of ShiftFinder or others.
– With consent: Where you direct us to disclose your information or where consent is otherwise obtained.
We do not sell personal information to third parties.
5. International Transfers
Personal information may be processed or stored outside Ontario, including in the United States, where it may be subject to foreign laws. We ensure appropriate contractual and technical safeguards when information is handled outside Canada.
6. Data Security
We implement administrative, physical, and technical safeguards designed to protect personal information against unauthorized access, disclosure, alteration, or misuse. However, no system or transmission is completely secure, and we cannot guarantee absolute security. Users are responsible for maintaining the confidentiality of their account credentials.
7. Data Retention
We retain personal information only as long as necessary to fulfill the purposes described in this Privacy Policy, to comply with our legal obligations, and to resolve disputes. Information may be retained in de-identified or aggregated form for research or business purposes.
8. Your Rights and Choices
You have the right to access, update, or correct personal information in your account settings. You may also request access, correction, or deletion of personal information by contacting us at the email below. We may require verification of identity before processing requests. Please note that deletion may not be possible in cases where information must be retained for legal or contractual reasons, or while transactions are pending.
You may opt out of receiving promotional communications at any time by following the unsubscribe instructions in our emails or contacting us directly. Service-related communications will continue as necessary to provide the Platform.
9. Children’s Privacy
The Platform is not intended for individuals under the age of eighteen (18). We do not knowingly collect personal information from minors. If we learn that personal information has been collected from a minor without appropriate consent, we will take steps to delete it.
10. Changes to this Privacy Policy
We may update this Privacy Policy from time to time. Updates will be posted to the Platform with a revised effective date. Where required by law, we will provide additional notice or obtain renewed consent.
